I'm new at this starting my own Non Profit Shelter business in . Hempstead New York. What do I need for Shelter to be legally set up? how do I register my business and get licensing? How do I go about it? I was thinking where or because I'm trying to get licenses for . Net Shelter I am confused. Went to government sites and cannot find any information. Have been trying to read state governmen sites but I get frustrated.

Hi Vic, in zip code 39180, for a homeless shelter, you need a corporation set up. A nonprofit corporation set up. You cannot be a nonprofit without a nonprofit corporation.

Nonprofits means exempt from income taxes. You must collect and pay sales tax or if selling wholesale you must sell to others who have a seller's permit and also you must have a seller's permit as a wholesaler or retailer of taxable items even if you are a nonprofit.

The first thing to decide is what business entity structure to select. There is a sole proprietor, a partnership, or a corporation or LLC. In your case, you need a corporation because you are a nonprofit.

If you are a sole proprietor/owner, you will need a business license (business tax registration occupational business license), however, nonprofits may not need a business license because they are not entities for profit.

If you also use a business name to do business, you also need a DBA (Doing Business As). However, if you incorporate or form an LLC, you do not need to register your business name because the LLC name will be your business name.
